The learned counsel appearing for the parties brought to the notice of this Court that in the connected appeals arising out of the same acquisition, certain orders are passed on the applications for withdrawal of the amount by the Claimants. The order passed by this Court on 28th September, 2012 passed in Civil Application No.10704 of
948--ca.8812.16 ors withdrawal.odt 2012 in First Appeal No.667 of 2012 with other connected matters is placed on record. One more order is also placed on record passed on 3rd March, 2016 in Civil Application No.2660 of 2016 in First Appeal No.1367 of 2015 with the connected matters. Both the orders are placed on record. The learned counsel submitted for passing the similar order in the present matters. In view of the above, the following order is passed -
O R D E R
I.
The Applicants are allowed to withdraw 25% of the amount on furnishing an undertaking to this Court that in the event the Applicants are required to deposit the amount, the Applicants would deposit the same within (1) month.
II.
The Applicants are allowed to withdraw 50% of the amount on furnishing solvent security of the said amount.
III.
The Applicants are allowed to withdraw 25% of the amount on furnishing bank guarantee of the said amount.
IV.
The civil applications are accordingly disposed of. [ P. R. BORA, J. ] ndm
