Today when this matter was called, both the learned counsel submitted that the mediation has succeeded and the parties have arrived to the amicable settlement amongst them. In fact, it is pointed out that the compromise is also filed in the Court of the Judicial Magistrate First Class, Amalner, district Jalgaon in Criminal Misc. Application No. 240/2011.

Mr. B.R.Warma, the learned counsel for respondent No. 1, upon instructions of his client, has made statement that since the matter is compromised, his client will not press for the execution.

Since the matter is settled out of the Court in between the parties, nothing survives in the present matter. The present Writ Petition is disposed of.
