We have heard Mr. Jadhavar, learned counsel for the petitioner.

The preliminary objection is raised by respondents even in the affidavit-in-reply that the petitioner has alternate remedy of an Appeal. 3.

As the petitioner has an alternate remedy, we are not inclined to entertain the present writ petition.

The writ petition is disposed of with liberty to the petitioner to avail the alternate remedy. All contentions are kept open. No costs.

In case, an Appeal is filed by the petitioner, the Appellate Authority shall consider the time spent in prosecuting the present writ petition.

In case, such an Appeal filed by the petitioner, the Appellate Authority may endeavour to decide the said Appeal expeditiously.
