We have heard Mr. Panpatte, learned Counsel for the petitioner and the learned A.G.P. for respondents no. 1 to 3.

The impugned order does not have any relevance with the proposal submitted. The proposal is submitted by the management seeking approval to the transfer of the petitioner on aided post with effect from 01.07.2020. The petitioner was initially appointed on unaided post on 02.08.2010. The proposal (Page No. 31) submitted by the Headmaster to the Deputy Director of Education also suggest that the petitioner is

2 wp 8200.2021 transferred on the aided post on 01.07.2020. The detailed proposal also suggest that the petitioner is appointed on aided post on 01.07.2020. The Deputy Director of Education could have considered the proposal as was submitted by the management on it's own merits.

In light of that, the impugned order is quashed and set aside. The Deputy Director of Education, Nashik Division, Nashik shall consider the proposal submitted by the management (Page Nos. 31 to 34), on it's own merits, in accordance with law, expeditiously and preferably within a period of four (04) months.

The petitioner may refer to the judgment of this Court dated 04.07.2019 in Writ Petition No. 1493 of 2018 with connected writ petition.

Writ Petition is accordingly disposed of. No costs.
