1) Heard learned counsel for the applicants. It appears that original respondent No.3 Bijalabai is dead. Learned counsel submits that her legal representatives are already on record as claimants and respondents and there is no need to bring more legal representatives on record of the appeal by filing such application. Learned counsel seeks to delete respondent No.3. Permission to

2 CA 5841 of 2014 delete respondent No.3 is granted. However, respondent No.4 Shilpa cannot be deleted as she is entitled to succeed to the property of the deceased as she is daughter of the deceased. So the application in that regard is rejected.
