S.S.SHINDE & P.R.BORA,JJ.

DATE : 5 th February, 2016.

PER COURT :

1) Heard. In view of the affidavit in reply filed by the Zilla Parishad and in particular paragraph 5 thereof, in terms of the Guidelines of N.R.H.M. and general procedure, one person cannot render his/her services on two different posts, i.e. ASHA & Block Mobilizer, as the nature of work of these two posts is totally different. In that view of the matter, we are unable to persuade ourselves to grant any relief to the petitioner. However, in case, in future, the petitioner resigns from the post of Sarpanch, and if she participates in the process of selection, her candidature may be considered for

the post of Block Mobililzer, in accordance with the procedure established.
