Petitioner is objecting to change of nominee representing Wadgaon Sawatal Vividh Karyakari Society for the purpose of participation in the election to the District Central Co-operative Bank. Petitioner contends that his name was forwarded by the society as nominee for elections to the District Central Co-operative Bank. However, after the general elections of the Managing Committee of the primary society. Acting upon the resolution adopted by the society, name of petitioner has been substituted. 2.

In our view, the action of the District Co-operative Election Officer is in consonance with Rule 10(4) of the Election Rules. Petitioner does not dispute the factum of holding of general election or the resolution authorising the nominee to participate in the process of election of federal society. Petitioner contends that no inquiry as contemplated under Rule 11 has been conducted by the District Co-operative Election Officer. Since

wp4222.15.doc petitioner is not disputing the factum of holding of general election or the resolution nominating another person for participation in the election to the District Central Co-operative Bank, in our opinion, the grievance raised by petitioner in the instant petition is without any foundation and does not deserve any consideration. Writ petition is devoid of substance hence stands rejected.
