Learned counsel Shri. Bhavthankar for the applicant submits that the petitioner-society had raised the dispute against respondent No. 1. This dispute was allowed and appeal was partly allowed. Against the decision in appeal, society has preferred this writ petition.

Learned counsel Shri. Bhavthankar for the applicant submits that vide Exhibit-A respondent No. 1 was called upon by ca13965.19
the petitioner-society to settle the claim once and for all. Accordingly vide Exhibit-B amount of settlement was fixed at Rs.1,50,000/-. The said amount has been paid by respondent No. 1 vide cheque No. 514988 drawn on SBI, Nanded. Learned counsel Shri. Bhavthankar makes a statement at Bar that the cheque has been honoured and the society has received its amount.

Learned counsel Shri. Gandhi h/f Shri. Mandlik, learned counsel Shri. Mandlik for the petitioner submits that communication was made to the petitioner-society but it has not responded and this writ petition can be disposed of on the statement made by the learned counsel Shri. Bhavthankar. In view of this, since the matter appears to have been settled as contended by Shri. Bhavthankar, learned counsel for the petitioner, writ petition is disposed of as withdrawn. 5.
