Learned counsel for the applicant seeks leave to withdraw the application with liberty to take out appropriate application for discharge in the event of filing charge sheet by the Investigating Officer. 2] In fact, we need not observe anything about the remedy available to the litigant. Therefore, even praying for such liberty is unwarranted.

3] The application is dismissed as withdrawn with observation that in case there is remedy available to the petitioner in law, petitioner can always avail the same.
