IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO.5441 OF 2016 IN WRIT PETITION NO.2887 OF 2015 RAMESH BHAGWANRAO UNWANE APPLICANT

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS RESPONDENTS Mr.S.V.Kuptekar h/f Mr.V.D.Salunke, Advocate for the applicants. Mrs.S.S.Raut, AGP for respondent Nos. 1 and 2. ( CORAM : RAVINDRA V. GHUGE, J.) DATE : 29/04/2016 PER COURT :

1.

The applicant/petitioner prays for reconsidering the order passed by this Court on 23/02/2016 by which his petition was Admitted, interim relief was refused and Rule has been expedited. 2.

Learned Advocate for the applicants submits that the seniority list dated 01/01/2006 indicates that he is at Sr.No.64 and respondent No.4 is at Sr.No.65. He has always been senior to respondent No.4. He, therefore, prays that the order dated 23/02/2006 be reconsidered and interim relief be granted to the applicant.

3.

The learned Advocate has taken me through the grounds set out in the application.

4.

I have considered the submissions of the applicant. 5.

Interim relief was refused to the applicant since the revised seniority list indicates that the petitioner is at Sr.No.43 as on 01/01/2012. Respondent No.4 is at Sr.No.23. This order was passed on the basis of the last revised seniority list and hearing in the matter was expedited.

6.

I do not find that the applicants have succeeded in pointing out any error on the face of the record so as to reconsider the same. 7.

The civil application, being devoid of merit, is therefore, dismissed.
