The learned counsel for the applicants submitted that in connected matters, this Court has permitted the applicant therein to withdraw 25% of the deposited amount on submitting an undertaking to the satisfaction of the Registrar of this Court; 25% amount on furnishing solvent surety and 25% amount on submitting bank guarantee. Similar order is sought in the present matter. 2.
The learned counsel for the acquiring body does not have any objection to pass such order. Hence, the following order:
ORDER
i) The applicants are permitted to withdraw 25% of the deposited amount on submitting an undertaking to the
1049-CA-7415-2018 withdrawal.odt (2) satisfaction of the Registrar of this Court; further 25% amount on submitting solvent surety; further 25% amount on submitting bank guarantee of any nationalized/scheduled bank in the like amount.
ii) Balance 25% of the amount be invested in Fixed Deposit Receipt in any nationalized bank, for the period till disposal of the appeal.
iii) The civil application stands disposed of.
