Heard learned counsel for the parties. Read the judgment, para Nos.16 and 17. Considering the reasonings, I am inclined to allow the withdrawal of full amount subject to conditions as follows :

The Civil Application is allowed. The amount deposited by the acquiring body be paid to the respondents, 50% on undertaking, 25% on furnishing solvent surety and 25% on furnishing Bank guarantee of any Nationalised Bank. ( A.M. DHAVALE ) JUDGE fmp/
