Heard the learned counsel appearing for the appellant/applicant and the learned A.P.P.

appearing for respondent/State.

Perused the notes of evidence and also the findings recorded by the trial Court. The findings recorded by the trial Court, prima facie, appears to be in consonance with the evidence brought on record. Since the appeal filed by the

1774.17appln appellant is pending for consideration, we do not wish to elaborate on the evidence. The appellant was not on bail during the trial.

For the reasons aforesaid, the application stands rejected.

The Registry of this Court shall send original Record and Proceedings to the Registry of Additional Sessions Judge, Biloli. Upon receiving the original record and proceedings by the Registry of the Additional Sessions Judge, Biloli, the Registry of concerned Court shall prepare the paper book and send it back along with original record and proceedings, as expeditiously as possible, and preferably within three months from receipt of the original record and proceedings.
