The petitioner is praying for issuance of directions to respondent Nos. 3 and 5 to include the name of the society, which the petitioner represents, in the final list of voters for the purpose of conducting of election of Nanded District Central Co-operative Bank Ltd. The claim of the petitioner for inclusion of name of the society in electoral roll has been turned down on the ground that the said society is defaulter of District Central Co-operative Bank. The petitioner disputes the position as disclosed in the order impugned in the matter.

In exercise of extra ordinary writ jurisdiction under Article 226 of the Constitution of India, enquiry in respect of disputed contentions

wp4395.15 -2raised in the petition need not be conducted. Apart from this, it is observed that the process of election programme of District Central Co-operative Bank is at advanced stage and only the stages of allotment of symbols and recording of votes are remaining. In this view of the matter, at this advanced stage of election process of respondent No.7 Bank, no interference is called for. Writ petition stands rejected.
