Mr. Golegaonkar, the learned counsel, on instructions, states that the Petitioner No. 1 is not interested in prosecuting the present writ petition as he is retired. Liberty may be given to the Petitioner No. 2 to independently challenge the order invalidating the caste claim.

In the light of above, as Petitioner No. 1 does not want to prosecute the present writ petition, the writ petition stands dismissed as withdrawn to the extent of Petitioner No. 1. Liberty to Petitioner No. 2 to assail the order as may be permissible in law. Writ petition is disposed of. No costs. 3.

In view of disposal of writ petition, civil application also stands disposed of.
