Heard the learned Advocate representing all the respective parties. The learned Advocate for the petitioner submits that the petitioner was disqualified by 'No Confidence Motion' with a margin of seven by two. Out of total number of members seven persons have voted against the petitioner Sarpanch.

The learned Advocate for the petitioner submits that against some of the members disqualification proceedings were pending and that they were not entitle to vote for the 'No confidence Motion'. The learned Advocate for the respondents submits that the application for disqualifications are rejected by the Collector, and in any event, there was no disqualification as on the date of 'No confidence Motion'. In view of the same, the petition is dismissed.
