Heard learned Counsel appearing for the applicant and learned Counsel appearing for the Insurance Company. 2.

Having regard to the contentions raised in the present application and considering the defense raised by the appellant Insurance Company in its appeal, I deem it appropriate to allow the applicants / original claimants to withdraw 50 per cent of the amount deposited by the Insurance Company on submitting an undertaking that in the event of passing of any adverse order against them, they will re-deposit the said amount within two months of passing of the said order. Remaining 50 per cent amount be deposited in any nationalized Bank for a period till disposal of the appeal. Civil Application stands disposed of.
