Mr. Kale, learned Advocate for the petitioner submits that the appeal is still pending before the Sub Divisional Officer. Notice is issued under Section 178 of the Maharashtra Land Revenue Code, 1966 for paying the amount.

The learned AGP submits that the Sub Divisional Officer has not passed any order of stay. In view of that, respondent No.3 can issue notice. The petitioner could have file application for stay in appeal. 3.

The petitioner is at liberty to file application for stay in the appeal. Thereafter, the concerned authority can consider the same on its own merits.

The writ petition is disposed of. No costs.
