CORAM

: KISHORE C. SANT, J.

DATED : 01.07.2024 PC :- 01.

The applicant to satisfy the office that the entire amount as per award is deposited. It is disputed that the amount deposited is lesser than the actual calculation. The learned Advocate for the applicant submits that the amount is deposited considering that the amount of 'no fault liability' is already paid. Said fact is disputed by the learned Advocate for the claimants. He confirms that that the amount towards 'no fault liability' is not received by the claimants. In view of the same, the applicant to satisfy the office that either 'no fault liability' amount is paid to the claimants or that the amount deposited is total amount considering the 'no fault liability'. If the amount deposited is lesser, in that case the appellant-applicant to deposit the remaining amount within four weeks thereafter. 02.

Subject to above compliance, the civil application for stay is allowed in terms of prayer clause "C" and is disposed off. [KISHORE C. SANT, J.] snk/2024/JUL24/ca4590.23
