This application is filed seeking permission to withdraw the amount of compensation deposited by the Appellant in this Court.

Learned Advocate for the Applicants has brought on record copy of order dated 18.08.2023 passed by this Court in Civil Application No. 10211/2023 along with connected matters arising out the same proceeding. This Court by way of said order has permitted the claimants therein to withdraw entire amount deposited by the Appellant in this Court.

Learned Standing Counsel for UOI vehemently opposes the Application.

Considering that earlier this Court had passed the order, this Court finds that it would not be desirable to deprive the present Applicants from the amount of compensation. Hence, the order:

O R D E R

(a) Application is allowed.

(b) Applicants are permitted to withdraw entire amount deposited by the Appellant in this court by filing an undertaking to the satisfaction of learned Registrar (Judicial) that in case the Appeal is decided against them, they shall redeposit the amount with interest within 12 weeks from such judgment.
