Mr. Khedkar, the learned counsel for the petitioner submits that, the seniority list prepared by the Education Ofcer is illegal. The right of the petitioner to be promoted is jeopardised. The petitioner is entitled for promotion. The learned counsel for respondent No.3 submits that the petitioner has remedy of appeal before the Commissioner.

In view of that, the Writ Petition is disposed of with liberty to the petitioner to avail the alternate remedy. No costs. All contentions are kept open.
