PER COURT :

1) Heard Shri Ganesh Patil, learned counsel for applicants-appellants. The learned counsel pointed out that on 16th November, 2017, following order was passed in the second appeal, - "Paper book be filed within a period of twelve weeks from today.

If paper book, as directed, is not filed within the stipulated time, the matter shall stand dismissed without further reference to the court."

2) The learned Counsel further submits that inadvertently, the paper book could not be filed within the given period and resultantly, the appeal has been dismissed. The learned counsel undertakes to submit the paper book within two weeks. In view of the undertaking so given, the second appeal stands restored to its original file.

3) List the matter after two weeks.

4) It need not be stated that failure on part of the appellant in submitting the paper book will result in reviving the earlier order dated 16th November, 2017.
