Mr.R.A.Tambe, learned counsel for the applicants states that in the year 2018 itself legal heirs of respondent No.5 have been served but they have not caused appearance.

Applicants have assigned sufcient cause for not preferring the application within the specifed period. In this view of the matter, delay is condoned. Abatement is set aside. Legal heirs of respondent No.5 be brought on record. Amendment be carried out within a period of two weeks.
