Learned counsel for the applicant produced on record copy of charge-sheet filed in this matter. The same is taken on record and marked 'X' for identification. He submitted that Investigating Ofrficer, after carrying out the investigation, found that the present applicant was not present on the spot of incident at the time of incident, and therefore, not involved in the crime. Charge-sheet placed on record clearly indicates that the present applicant was not involved in the crime and Investigating Officer has mentioned that his name is deleted from the present crime as per Section 189 of BNSS corresponding Section 169 of Cr.P.C.

Learned APP, on instructions, submits that report under Section 169 of Cr.P.C. is sent in respect of the present
