By this application, the applicant - original appellant seeks to condone the delay of 5315 days caused in filing the application for setting aside the order of the Registrar [Judicial] of this Court dated 02/09/2008, by which the appeal came to be dismissed as against respondent no.1 for want of steps.

After considering the reasons as explained in Paragraph Nos.2 to 5 of this application, it appears that, sufficient reasons are made out for condonation of delay as well as setting aside the order of Registrar [Judicial]. Hence, application is allowed in terms of prayer clauses - (B) and (C).

Re-issue notice to respondent no.1 in appeal, returnable on 03/08/2023.
