IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.4806 OF 2015 Smt.Nagina Abbas Tadvi Petitioner

Versus

The State Election Commission and others Respondents Mr.D.R.Irale Patil, advocate for the petitioner Mr.S.T.Shelke, advocate for Respondent No.1.

Mr.N.B.Patil, A.G.P. for Respondents No.2 to 4. CORAM : R.M.BORDE & P.R.BORA, JJ.

DATE : 25th June, 2015 PER COURT:

The petitioner is praying for prescribing reservation for S.T. Category during elections to Village Panchayat. Learned Counsel for Respondent-State Election Commission points out that total population of the village as per 2011 Census is 1899, whereas, population of S.T. Category is to the extent of 101. The ratio requisite for prescription of reservation as per the formula adopted by the State Election Commission comes to 0.47%, which is inadequate for prescription of reservation for the said category. In view of the explanation tendered by the State Election Commission, grievance raised by the petitioner, in the instant petition, does not deserve consideration.

Writ Petition stands dismissed.
