This is an application for bail since the applicant is arrested in connection with Crime No. 224/2014 for the offence punishable u/s 302 read with 34 of the Indian Penal Code registered with police station Parner, Dist. Ahmednagar.

Heard Mr. G.B.Kadlag, learned counsel for Applicant and Mr. A.V.Deshmukh, learned A.P.P. for Respondent - State.

Deceased in the present prosecution case is one Santosh. According to prosecution, Santosh was having illicit
2 Cr.Apln. 2004.2015 relations with one Vaishali, who is also one of the co-accused, who is released on bail by this Court only because of her womanhood. Deceased belonged to the lower caste, whereas Vaishali belong to upper class. They were having illicit relations with each other and due to the same, she became pregnant and the deceased used to spread this particular news in the society. Therefore, the persons belonging to upper caste, including present applicant, were nursing grudge against deceased.

From the charge sheet, it is clear that four witnesses have seen the deceased lastly alive in the company of present applicant. Present applicant was taking deceased on his motorcycle and at that time deceased was under intoxicated condition. In the intervening night in between 02/10/2014 and 03/10/2014, deceased was done to death. 5.
In view of the fact that deceased was lastly seen alive only in the company of present applicant, applicant is dis-entitled from claiming any discretionary relief from this Court.
