ORDER

(22nd March, 2025) 1.

The original claim for the compensation in an injury claim was filed through his next friend i.e., real brother Sanjay Mohan Pagare. 2.

This appeal is for enhancement of the compensation. Parties agreed to settle the dispute between themselves for Rs. 4,50,000/-. In the facts of the case, amount settled is reasonable.

Next friend of the claimant is present before the Court. The settlement terms are duly signed by him and attested by their advocates. Since the Tribunal has accepted the claim of the claimant through next friend, this Panel does not find any reason not to accept the same in this appeal. Terms of 116-FA-261-2023.odt

settlement are taken on record and marked as "X" for identification. 4.

At the request of learned counsel for the claimant, the amount of compensation be deposited to Tribunal within a period of 6 weeks. Tribunal to permit withdrawal of the amount taking into consideration best interest of the claimant.

In view of this, appeal stand disposed of.

The Court Fee Refund Certificate be issued as per the rules. 7.

The Civil Application(s), if any, stand disposed of. 8.

The award/decree be drawn up in terms of compromise. 9.

No order as to costs.
