The matter is pending since 2013. The notice of the present proceeding could not be served on respondent No. 9, one of the accused, who is acquitted. There are many other accused and the case is not making progress only due to this circumstance. Seen the record. The matter is dismissed as against respondent No. 9.

Heard the learned counsel for applicant. Seen the contents of the application filed for delay condonation. The delay of 149 days has been caused. The application is allowed. Delay is condoned.

The leaned counsel for the applicant is to argue the matter for grant of leave on 20.3.2015.
