The learned counsel for the applicant submits that the applicant is suffering from invasive Right Breast Carcinoma disease. She also submits that the applicant does not have capacity to defend the proceedings initiated by the husband bearing H.M.P. No.32/2025, pending before the learned Civil Judge, Senior Division, Pusad.

The learned counsel for the respondent has objected to the application.

Considering the applicant's position and, also, considering that there is no dispute as regards the ill health of the applicant, the present application is allowed in terms of prayer clause "B".
