IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.4811 OF 2015 Ramdas Muralidhar Shejul Petitioner
Versus
The State of Maharashtra and others Respondents Mr.K.N. Shermale advocate for the petitioner Mr.S.G. Karlekar, AGP for Respondent State __________ CORAM : R.M. BORDE & P.R. BORA, JJ Dated : 10th JUNE, 2015.
PER COURT :- The petitioner has tendered an application to the Returning Officer, requesting for issuance of copies of certain documents. Document at Sr.No.2 i.e. marked copy of the electoral roll, has not been supplied by the Returning Officer, on the ground that, the said copy is required to be preserved in a sealed cover, in view of Rule 52 of the Maharashtra Co-operative Societies Election to Committee Rules, 2013. The copies of the other documents as requested by the petitioner are stated to have been handed over by the Returning Officer.
We do not find any irregularity or arbitrariness in the action of the Returning Officer, in refusing to deliver marked copy of the electoral rolls to the petitioner.
In view of above, writ petition does not deserve to be entertained and as such, stands rejected.
