The learned counsel for the petitioners submits that the change report proceedings are pending. However, the Assistant Charity Commissioner, Parbhani has not taken a decision for provisional acceptance as required under proviso to subsection (2) of Section 22 of the Maharashtra Public Trust Act, 1950. 2.

The learned Assistant Government Pleader accepts notice for respondent Nos. 1 to 4.

The petitioners may file application with respondent No. 2 where the change report proceedings are pending for orders as per the proviso to subsection (2) of Section 22 of the Maharashtra Public

2 947-WP-1203-2021 Trust Act, 1950. On receipt of the said application, respondent No. 2 shall pass the order on its own merits as required under the said provision.

Writ Petition is disposed of. No costs.
