Heard learned Counsel for the respective parties. 2.

The present petition takes an exception to the order 16.09.2020 passed by respondent No.1, M.S.R.T.C., the second Appellate Authority. 3.

Learned Counsel for the respondent, M.S.R.T.C. raised a preliminary objection by filing an affidavit in reply, contending that an alternate and efficacious remedy is available to the petitioner to challenge the impugned order before the Industrial Court. 4.

Having gone through the record, petitioner was dismissed from service on 14.03.2018. The petitioner filed departmental First Appeal, which was dismissed and in Second Appeal, the impugned order was passed.

In view thereof, the Writ Petition is disposed of as not maintainable.

The petitioner is at liberty to file an appropriate complaint before the Industrial Court.

The delay occurred while prosecuting the present petition shall be considered by the Industrial Court while dealing with the proceedings, in accordance with law.

8.

It is made clear that the Industrial Court shall decide the matter on its own merits and without being influenced by any observations made herein.
