..APPLICANT

VERSUS

Mangesh s/o Avinash Dabhade, Age: 25 years, Occ: Service, R/o. House No.1, Anant Colony, Aagarkala Mala, Railway Station, Ahmednagar, Tal. & Dist. Ahmednagar.

..RESPONDENT Mr C.T. Jadhav, Advocate for applicant;

Mr D.R. Adhav, Advocate for respondent CORAM : N.W. SAMBRE, J.

DATE : 19th JULY, 2017 ORAL ORDER :

The prayer for transfer is opposed by the respondent-husband on the ground that the proceedings are initiated based on the cause of action, as the parties are residing together within the jurisdiction of Court at Ahmednagar.

78.17mca (2) 2.

In my opinion, the said objection is required to be overruled.

2.

Misc. Civil Application stands allowed in terms of prayer clause (B), particularly having regard to the distance between Ahmednagar and Karhad, District Satara, which in my opinion, will cause inconvenience and hardship to the applicant for travelling, who is already reported to be taking treatment for lumber pain.
