This application has been taken out by a candidate contesting the elections to Agricultural Produce Market Committee (APMC), Tadkalas, which is scheduled to be held on 16/04/2017 to be added as a party respondent to the petition. This on the ground that if the petition filed challenging the exclusion of the petitioners from the list of voters entitled to vote at the election of APMC, Tadkalas on 16/04/2017, it would prejudicially affect the applicant in his election. 2.

Mr.Maske, learned counsel appearing for the petitioners has no objection if the applicant is heard in respect of his objections alongwith the petition. In fact, he points out a copy of the petition khs/APR.2017/4936

has already been served upon the applicants. This would enable the applicant to contest the petition and he has no objection if the applicant is permitted to file an affidavit to contest the present petition.

In the above view, civil application is allowed to the extent that the applicant is allowed to intervene in this petition and make his submissions opposing the petition and also file an affidavit, if so advised. In the circumstances, there is no need to join the applicant as a party in the petition by amending it.
