Rule. Rule made returnable forthwith and heard finally with consent of learned counsel for the parties.

After hearing learned counsel for petitioners and respondents, it is apparent that on the date of filing of nomination, receipts about applications having been filed by the petitioners before scrutiny committee had not been submitted. Since at the time of scrutiny, election officer noticed lacunae, he has rejected the nomination. After applications were scrutinized and orders were passed, lacunae were sought to be removed by both petitioners. Elections have reached to polling and all other stages are over.
3 W.P.4351.15 Having regard to aforesaid, I am not inclined to interfere with the process of election at this stage. The petitions, as such, stand dismissed. Rule stands discharged.
However, it would be open for the petitioners to file appropriate proceedings questioning the rejection of their nomination papers including an election petition. Sd/- ( SUNIL P. DESHMUKH, J. ) MTK
