Versus

The State of Maharashtra & others Respondents Mr.C.R.Deshpande, Advocate for the petitioners in W.P.No.3431/2017. Mr.N.T.Bhagat, AGP for Respondent-State.

CORAM : RAVINDRA V. GHUGE, J.

DATE : 18/07/2019 PER COURT :

The learned advocate for Hirabai and others, who are petitioners in the 1st petition, submits that he has received oral information that the original tribal transferer and the original transferee have all passed away. The petitioners or their legal representatives are not keeping contact and there are no instructions.

- 2 - In view of the above, the 1st petition is disposed off. Rule is discharged. It, however, be noted that in the event any legal representative of the deceased litigants approaches this Court with promptitude for any grievance surviving, the Civil Application for restoration would be considered on its own merits. In the 2nd petition, none appears for the petitioners. The order impugned in the 1st petition is also under challenge in the 2nd petition.

As such, for the same reasons, the 2nd petition is also disposed off. Rule is discharged. It, however, be noted that in the event any legal representative of the deceased litigants approaches this Court with promptitude for any grievance surviving, the Civil Application would be considered on its own merits.
