The First Appeal is filed by the State are dismissed as withdrawn in terms of the order passed by the Lok Adalat on 12/02/2022 in First Appeal No.58 of 2008 along with other appeals. The present application is filed for withdrawal of amount.

The learned Advocate for applicant submits that after the dismissal of the appeals, the claim amount is deposited in this Court. 3.

In the event, the claim amount is deposited in this Court and is not transmitted to the Reference Court and the amount is available in this Court, the same shall be disbursed to the claimants in terms of the order passed by the Reference Court, along with accrued interest thereon, subject to filing of undertaking to the satisfaction of the Registrar Judicial of this Court.

The legal heirs of claimant No.1 would be entitled to receive the claim amount in equal proportion to the extent of the share of deceased claimant No.1.
