IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 928 CIVIL APPLICATION NO.8602 OF 2017 IN FAST/11871/2017 KALAWATIBAI GOVINDRAO KULKARNI (DIED) THR LRS MANIK AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Applicants : Mr.

Wasif Salim Shaikh h/f.

Mr. Narwadkar Mrigesh D.

AGP for Respondents - State : Mr. S. N. Kendre ...

CORAM : SANDIPKUMAR C. MORE, J.

DATE : 12.10.2022 PER COURT :

Heard rival submissions. The applicants are seeking condonation of delay of 2851 days which appears to be caused due to their financial crisis. The learned AGP strongly opposed the application on the ground that there is also circulation delay. The respondent No. 3 -Acquiring Body though served, remained absent. 2.

However, considering the statutory right of the applicant delay of 2851 days stands condoned subject to condition that the applicants shall not claim any interest for the aforesaid period of delay and also for delay in circulating the matter belatedly.

3.

The appeal be placed for admission after removal of office objections, if any.

4.

The application is accordingly disposed of.
