We have heard Mr. Karad, learned counsel for the petitioner and Mr. Deshpande, learned counsel for respondent No. 4. 2.

Mr. Deshpande, learned counsel on instructions states that the representation of the petitioner would be decided by the respondent authority on its own merits, in accordance with law, policy and rules. 3.

In the light of that, the representation made by the petitioner (page nos. 209 and 212) shall be decided by the respondent No. 4 authority on its own merits, in accordance with law, rules and

It is made clear that, we have not considered the contention on merits of the matter.

Mr. Barde, learned counsel appears for the intervener for the very subject raised in earlier writ petition which is pending. 6.

Be that as it may, we have not considered the merits of the contention in the present petition and on the basis of the statement of the learned counsel for the Corporation, the writ petition is disposed of. No costs.
