Heard learned Counsel for the applicant - wife. The respondent husband, though served but remained absent. 2.

The applicant - wife is seeking transfer of Marriage Petition No.69 of 2022 pending in the learned Civil Judge (S.D.), Dhule fled by respondent - husband for restitution of conjugal rights, to the Court of Civil Judge (Senior Division), Beed. According to the applicant-wife, she is residing at Dongarkini, Tq. Patoda, District Beed, which is 280 kms away from Dhule. Moreover, she has also fled proceedings for getting divorce before the Civil Judge (Senior Division) Beed and the respondent - husband is appearing in that matter. In view of the same, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) The H.M.P. No.69 of 2022 pending in the Court of Civil Judge Senior Division, Dhule, is

2 918 MCA 122-22 transferred to the Court of Civil Judge (Senior Division), Beed for disposal according to law. (iii) The respondent is directed to appear before Civil Judge (Senior Division), Beed on 28/11/2022.

(iv) The application is disposed of accordingly.
