This is an application for regular bail in Crime No.10 of 2016, registered at Chopada Rural police station, for the offence punishable under Section 399 of the Indian Penal Code and under Section 3/25 of the Indian Arms Act.
2] Heard Shri N.V.Gaware, learned counsel for applicants and Shri S.N.Morampalle, learned A.P.P. for State. Perused papers of investigation.
3] It can be seen from first information report that offence under Section 399 of the Indian Penal Code is alleged against four persons. Co-accused Javed Bagewadi has been released on bail by the learned Additional Sessions Judge, Amalner vide order dated 20.4.2016 in Criminal Bail Application No. 69 of 2016.
crap2038.16 4] The role attributed to present applicants is almost identical and on the rule of parity applicants would deserve their enlargement on bail. Hence the following order.
O R D E R
(i) Criminal Application No. 2038 of 2016 is allowed.
(ii) Applicants no.1-Mayur Namdeo Takale and no.2-Hemant Baburao Badade are released on bail on P.B. and S.B. of Rs. 15,000/- each.
(iii) Applicants shall not tamper with prosecution evidence and shall make themselves available as and when required for investigation/interrogation. (iv) Bail before the Trial Court.
