The application is filed for restoration of Criminal Application No. 5950/2016. Heard the learned counsel for the applicant. The learned counsel has taken the blame to himself. There is delay of 10 days and for that also, the learned counsel takes blame to himself. In view of these circumstances, the application is allowed. Delay is condoned. The order of dismissal dated 17.2.2017 is recalled. Matter is restored. 2.
Learned counsel Shri. R.D. Birdar for original complainant submits that Criminal Revision Applicant No. 218/16 is pending before other Court which is regular court for revision. In view of this statement, present matter bearing Criminal Application No. 5950/2016 is to be kept before either this Court or the Court before whom aforesaid revision is pending.
