It appears from the record that the, appellant Madhya Pradesh

2 904-CA 90071-2012.odt State Road Transport Corporation has filed first appeal bearing First Appeal (Stamp) No. 12863 of 1993. It further appears that, Civil Application No. 5273 of 1993 is filed by the applicant Corporation seeking condonation of delay of 154 days. It is pending since the year 1993. It further appears that the Civil Application No. 5274 of 1993 has been filed by the applicant Corporation seeking stay to the impugned judgment and order. It is also pending since the year 1993. It further appears that nobody was appearing for the applicant/appellant Corporation and therefore, this Court vide order dated 28.02.2013 issued Court notice to be served upon the appellant Corporation. The Court notice has been duly served on or about 22.08.2013, however, nobody is appearing for the applicant/appellant. It is thus, quite obvious that the applicant/appellant is not interested in prosecuting the civil application seeking condonation of delay and consequently the first appeal.

In view thereof, Civil Application No. 5273 of 1993 in FAST No. 12836 of 1993 is dismissed for want of prosecution. 4.
