Heard learned Counsel appearing for the applicants and the learned A.G.P. for respondent state.

These are the applications seeking withdrawal of the amount deposited by the State in the present appeals. Having regard to the objections raised by the State in exception to the awards impugned in the present appeals and considering the averments made in the applications for withdrawal of the amount, I deem it appropriate to pass the following order:

ORDER

1.

The applicants are permitted to withdraw 30 per cent of the deposited amount on submitting an undertaking that in the agp/-

BENCH AT AURANGABAD (2) CA NO.6244 of 2017 event any adverse order is passed, they will re-deposit the amount so withdrawn by them within four months of passing of such order. 2.

The applicants are also permitted to withdraw further 30 per cent of the deposited amount on submission of solvent surety or Bank guarantee in the like amount to the satisfaction of the Registrar (Judicial) of this Court.

3.

Balance 40 per cent of the deposited amount be invested in a Fixed Deposit Receipt initially for a period of two years and, if required, for further period till disposal of the appeals. Civil Applications stand disposed of.
