Learned counsel for the applicant submits that this Court by order dated 29.6.2015 permitted the applicant to withdraw the compensation amount deposited in this court to the extent of Rs.100/- per R out of the amount as awarded by the reference court at the rate of Rs.150/- per R. Learned counsel submits that Section 4 notification was published on 2.11.1972 and as such, the applicant may be permitted to withdraw the remaining amount of compensation deposited in this Court.

I have also heard learned A.G.P. for the respondent-State. 3.
Considering the above submission and the fact that the applicant is old aged person, the applicant is permitted to withdraw
942 ca7269.17 -2the remaining amount alongwith accrued interest, if any, on furnishing undertaking to the satisfaction of Registrar (Judicial) of this Court. Civil application is accordingly disposed of. 4.
The applicant Ganesh Shankar Patil is not in a position to attend the court to withdraw the compensation amount, as such his son was permitted by this Court to withdraw the amount as per earlier order. In view of the same, the son of the applicant Vivek Ganesh Patil is hereby permitted to withdraw the compensation amount falling to the share of Ganesh Shankar Patil. ( V. K. JADHAV, J.) rlj/
