This is an application for pre-arrest bail in Crime No.157 of 2015 registered at Ghansawangi Police Station, District Jalna for the offences punishable under Sections 420, 464, 465, 467, 469, 470 and 471 read with 34 of the Indian Penal Code.
Heard the learned counsel for parties. Perused papers of investigation.
It can be seen from FIR that offence occurred during the years 2007 and 2009. The sum and substance of accusations in FIR is that 100 farmers residents of Pimparkhed (Bk.), Ghansawangi borrowed crop loan from Bank of Maharashtra, Branch at Kumbharpimpalgaon. Applicant was working as Branch Manager at
the relevant time. It is alleged that Applicant in collusion with other officers disbursed loan on the strength of documents which were apparently false as no lands were in existence. It is apparent from copies of previous FIRs placed on record by Applicant that on similar set of facts reports were lodged earlier against Applicant and he was granted anticipatory bail by Sessions Court. In this premise this Court is inclined to grant protection to Applicant and proceed to pass the following order -
O R D E R
I.
Criminal Application No.2048 of 2016 is allowed. II.
In the event of arrest of Applicant in Crime No.157 of 2015 registered at Ghansawangi Police Station, District Jalna for the offences punishable under Sections 420, 464, 465, 467, 469, 470 and 471 read with 34 of the Indian Penal Code, he shall be released on bail on P.R. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand Only) each.
III.
Applicant shall not tamper with the prosecution evidence and shall make himself available as and when required for investigation / interrogation. [ INDIRA K. JAIN, J. ] ndm
