IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD CIVIL APPLICATION NO.9234 OF 2022 IN WPST/24936/2020 BHAGWAN DEVRAO PAWAR
VERSUS
THE ASSISTANT COMMISSIONER EMPLOYEES PROVIDENT FUND AND OTHERS Mr.S.B.Bhosale, Advocate for the applicant.
Mr.N.K.Choudhary, Advocate for respondent Nos. 1 and 2. ( CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.) DATE : JUNE 24, 2022 PER COURT :
1.
Delay of 35 days is caused in filing this application by which the petitioner prays for recalling of the order dated 20.12.2021 passed by the learned Registrar (Judicial) resulting in the dismissal of the writ petition on account of non removal of office objections. 2.
The petition was dismissed due to a default, at pre-notice stage. The learned Advocate representing the PF Authorities opposes this application.

- 2 - 3.
We are of the view that the delay of 35 days is neither inordinate nor deliberate. The learned Advocate for the petitioner submits that non removal of office objections turns on him and he assures that the objections would be removed.
4.
In the light of the above, this application is allowed with the following directions :- [a] All office objections shall be removed on or before 08.07.2022. [b] After removal of office objections in the writ petition, the writ petition shall stand restored at the stage at which it was dismissed and shall be listed for admission hearing on 18.07.2022 in the urgent category.
