In fact the said order is passed only in First Appeal Nos.362 and 363 of 2009, however, First Appeal numbers of other two matters are also mentioned in the title clause. Mr.Syed and Mr.Kulkarni, learned counsel for respective parties in First Appeal Nos.978/14 and 1189/14 submit that the said First Appeals be deleted from the order dated 15/10/2015.

2] In light of above, order dated 15/10/2015 stands recalled in First Appeal Nos.978/14 and 1189/2014. They are restored to their original position, as in fact no order was proposed to be passed in the said matters. Motion disposed of.
