Though the present application has been filed for condoning the delay in filing Second Appeal; yet, it appears that it is filed in ignorance of the Judgment and order passed by Hon'ble Apex Court in Suo Motu Writ Petition (Civil) No.3 of 2020. The Appellate Court decided the Miscellaneous Civil Application No.382/2016 for condonation of delay on 19.03.2020 and thereafter during the period of limitation to file appeal the lock-down was declared, and therefore, it will have to be considered that the Second Appeal is within limitation.
